Fnac Service: 60 licensees understand the tribunal
Sixty of the 231 employees that the company had FNAC SERVICE ago one year before the Industrial Tribunal to BOBIGNY to show that:
- the serious deficiencies that were causing massive dismissals notified in violation of legal provisions and commitments made by the management of the company into a backup job stopped in July 2006
- systematic violations of the law and labor regulations criminally punished because so many employees were precariously employed part time while working full time almost illegally through overtime.
sad record for a company and a group that, with rare indecency, boasted a year ago to reclassify all employees affected by the proposed closure .
be reminded that May 18, 2006, seeking to increase its profits, the group PPR decided to close finally its subsidiary Fnac Service specializing in photo work and has publicly committed to reclassify all 231 people under press releases widely broadcast.
The official reason for the closure: the transition from film to digital photography as if the transfer had been anticipated! Employees, thus leading to the staggering lack of foresight of a direction that had not taken the steps necessary to engage in digital photography as its major competitors have done.
The real reason: for 30 years, Fnac Service has regularly back to the Group FNAC significant benefits which were then distributed to shareholders as if they had been reinvested in the company, it could easily manage this particular mutation through a Management of Jobs and Skills (GPEC) which has been sorely lacking.
To do well, management through its CEO: Stéphane Grodner, therefore undertook to reclassify all employees either in the FNAC, either within the various structures composing the PPR . Little commitment binding in reality: the 231 employees would easily be reclassified into a group which counts 85,000 and that makes an annual turnover of 17.8 billion euros. employees believed they could give their confidence FNAC SA in that self-proclaimed "corporate citizen" as the PPR which claims on its website, its "social responsibility" and ensures show all his "attention to men and women" who work every day prosperity of its shareholders.
That confidence was quickly betrayed. To date, only about sixty employees was difficult reclassified ... 30% only in FNAC SA, and not more than three in the other Group subsidiaries PPR! Management is aware that she communicates so figures for reclassification completely fanciful in which it takes into account employees made redundant ... and then found, on their own, a job outside the group.
In reality, no serious action has been initiated reclassification despite the capacity of this powerful and prosperous economic group. Neither the company management, nor the group have implemented the necessary means to enable these reclassifications. No structures were in place, dedicated to this reclassification , presumably to save money that this group highly profitable has decided to allot elsewhere.
The works council has seized a first justice.
The works council has seized a first justice.
By order of January 5, 2007, the Tribunal de Grande Instance in Bobigny has taken the measure not only recall the FNAC group PPR and their legal obligations but also held to denounce the disloyalty shown by these companies in implementing the Safeguard Plan for Employment in the subsidiary FNAC SERVICE. FNAC SERVICE direction and PPR did was what to do. In evidence, and testifying to a stunning disregard for employees concerned and a curious conception of respect for judicial authority, FNAC has announced the morning of the hearing, January 2, 2007, sending 46 letters of dismissal to affected vendors So which stores have learned their dismissals during the proceedings before the Tribunal!
And just four weeks later , while nothing had ever been seriously implemented to ensure the reclassification defaulting it again several dozen employees who found themselves dismissed contempt reclassification of public commitments made a few months ago . The Labour Inspectorate of MONTREUIL just recently to report these serious deficiencies in refusing to authorize the dismissal of staff representatives and noting that the company management has not fulfilled its commitments. So sixty of these employees - which should probably be joined by others - who have already entered the industrial tribunal to punish see these serious violations of the law.
These are the same as employees who suddenly and illegally dismissed greatly appreciated Recent remarks by Denis Olivennes , CEO of FNAC (The Figaro.com, April 27, 2007), including:
"FNAC does not lay off. I am part of a tradition of exemplary social and economic dynamics of the business allows him to manage its smooth mutations "
" If we had to make a PACS with each employee so there is no redundancy, I will. "
